1. Scope
These terms govern your use of phoenixhubsolutions.com and, where applicable, the services contracted with Phoenix Hub Solutions. Specific service agreements (scope, pricing, SLAs) are set out in individual contracts and take precedence over this general page in case of conflict.
2. Use of the website
You agree to use this website only for lawful purposes and not to attempt to disrupt its operation or access data you are not authorised to access.
3. Lead generation service — key terms
- Leads are delivered on the basis described in our Lead Generation page and in the specific agreement signed with each client.
- Replacement policy: a lead is considered invalid when the contact details are wrong or non-existent, or when the record is a duplicate already delivered. Invalid leads are replaced or credited on the next invoice; it does not cover a contact showing no interest on the first call, since that is part of the client’s own sales work.
- Payment terms: monthly invoicing, due within 15 days of the invoice date unless the individual agreement states otherwise.
4. Intellectual property
Unless otherwise agreed in writing, deliverables produced for a client (campaigns, creative, website) are licensed or transferred as specified in the individual service agreement.
5. Limitation of liability
To the extent permitted by applicable law, Phoenix Hub Solutions is not liable for indirect damages, loss of profit, or loss of data arising from use of the website or the contracted services. Our total liability to a client for any claim relating to a service will not exceed the amount paid by that client for that specific service in the 12 months preceding the event giving rise to the claim. This limitation does not affect any non-waivable rights granted to the client under the consumer-protection law of their country of residence.
6. Governing law
These terms are governed by the laws of Malta, without prejudice to any mandatory consumer-protection rules applicable in the client’s country of residence.
